Mark Maxwell and Tim Young of North Carolina are foster parents to four boys ranging in age from 13 to 24. They are unable to jointly adopt the boys because despite being married in Washington, DC this year, the state of North Carolina prohibits adoption by same-sex couples.

After facing denial and discrimination in their home state of North Carolina, Mark and Tim travelled to Washington, D.C. to be legally married, they then became plantiffs challenging North Carolina's constitutional ban prohibiting the recognition of their family and marriage.
